Pinnacle HR would like to provide some clarification to employers regarding the 2010 Wage Case Decisions.

CEA HR and Consulting would like to provide some clarification to employers regarding the 2010 Wage Case

Decisions.

1. 2010 State Wage Case Decision

This decision affects State Awards only and those employers and employees to which those Awards apply,

namely Non-Constitutional Corporations.

The 2010 State Wage Case Decision covering increases to the State Minimum Wage and all State Awards was

handed down by the Full Commission of the South Australian Industrial Relations Commission (SAIRC) on 16

September 2010.

This decision covers increases to the State Minimum Wage and all State Awards. The Decision has granted an

increase of 3.5% to the State Minimum Wage (taking it to $580.30 per week) and 3.5% increase to all adult

Award wage rates. This increase will apply from the first full pay period on or after 1st October 2010.

2. 2010 National Minimum Wage Decision

This decision affects Modern Federal Awards only and those employers and employees to which those Awards

apply, namely Constitutional Corporations.

The 2010 National Minimum Wage decision was delivered by Fair Work Australia increasing the National

Minimum Wage by $26 per week, taking effect from the first full pay period on or after 1 July, 2010.

Exclusion: Social Community Home Care and Disability Services Award 2010

CEA HR and Consulting has received legal supportĀ that; employers covered by the SCDS Award are not obliged

to pass on the $26.00 wage increase recently granted by Fair Work Australia. There is only one qualification to

this; the Federal Minimum Wage has been increased to $596.90 per week or $15.00 per hour. This rate has universal application which means that if the SACS NAPSA rates for any classification level fall below the new

Federal Minimum Wage, employers will need to pay the higher rate with effect from the beginning of the first full

pay period on or after 1 July 2010.

In Summary, employers covered by the SCDS Award:

– Are not required to operate transitional arrangements before 1/07/2011

– Are not required to pass on the $26 wage increase

– Must pay at least $596.90 ($15.00 per hour)
